Mr. Rossi and his on line purchase
 

As he has already done some time ago, also this time Mr. Rossi bought on line a monitor from a deutsche website, paying by credit card. However, within few days the monitor stopped working.

Being the product under guarantee, Mr. Rossi decided to turn it to an Italian assistance centre, but he was negated the repair because the product had been bought abroad.

Consequently, the consumer contacted the seller, which addressed him to another assistance centre, starting by this way a series of liability denials from the local trader to the head quarter in the East Asiatic.

 

Solution of the case: who is liable in this case for the repair?

  • It is important to know that, from the beginning, you have to turn to your seller, who is liable for the product change or repair, without having to pay any additional sum;
  • the shipping costs for monitor delivery are in charge of the seller: consumer can be asked to pay them in advance, but later he must be reimbursed;
  • in case that both the reparation and the replacement are impossible to be done, the consumer can choose to benefit from an appropriate reduction of the price - if the product is damaged but still working - or even to cancel the contract, having back the sum already paid.
