Timeshare The timeshare enables consumer to buy a holiday accommodation for a specific amount of time each year (generally one or two weeks per year) for at least three years. In Italy timeshare ‘s owners are defended by the article 69 and the following of the Consumption Code. At EU level a Directive has been issued (the 94/47/CE) aimed at closing the different European legislations and at ensuring that consumers have adequate protection and information on the property chosen. This Directive has been implemented in all member states.
Your rights As buyer of a timeshare property you have a right to information. You can demand a copy of the brochure of your holiday property in your language containing all information about the property itself ( i.e. description of the property, its price, place). You can even ask for a translation of your agreement in case it’s written in a language different from yours. The contract must contain the names and addresses of the parties, the duration of the agreement in addition to the information on the property and on its maintenance. You have a right to a cooling off period starting from the day you sign the contract and lasting 10 days. During this period you can cancel your agreement without giving any reason and at any cost. Pay attention to some cost which may raise the price proposed. Among them: the costs of transport to the resort; the annual maintenance charges; the charges due to the legal assistance in case of dispute; any difficulties you can meet in case of resale and the risk of bankruptcy of the management company . |
