On line contract
A contract stipulated through the web is a regular contract, which follows to
civil code rules.
As normal contracts, an on line contract is to be considered stipulated when the
party who made the offer has been informed about the counter-party’s acceptance.
Indeed, buying in the web, consumer can chose between lots of products offered
by the seller and put them together in a “virtual cart”: only after this
operation the consumer will be asked to pay the related amount.
Actually, there are further ways of considering a contract signed. Indeed, the
consumer can propose to the seller his offer, so that the agreement will be
reached only with the seller’s acceptance.
Finally, a contract should be stipulated also by a “resolving act”, such as when
a license to use a software is downloaded on one’s personal computer. In these
cases, the contract is considered signed in the same place/time when the
implementation started.
