Distance selling
The term distance selling indicates a contract that is concluded between a supplier and a consumer under an organised distance sales or services provision scheme run by the supplier who, for the purposes of the contract, makes use of one or more means of distance communication up to and including the moment of contract formation. Distance selling includes tele-shopping, in which the selling of goods is proposed on TV, and contracts that are concluded on the phone. In this case, in order to validate the contract, the identity of the supplier and the commercial purpose of the call need to be explicitly indicated at the beginning of the telephone call. Distance contracts can also be concluded by fax, such as in the case of companies proposing internet connections. Moreover, distance selling also includes internet, emails, posted catalogues and many other communication systems. |
